I'm really not sure it's a glitch, as bypassing triggers like that seems to be the main point of the Penguin Effect. Besides, the game has shown several times that it won't let you use the Penguin Effect when you aren't supposed to. It's shown even in the very same map. Trying to use the penguin effect while on the road to the Deciding Street while in the Netherworld will block you. This doesn't seem to be mentioned anywhere in the article. It turns out you can go back to The Deciding Street by penguin sliding through the area that makes the green creature appear, but you have to do it twice when going into the Netherworld and when going out because the squares work any time you actually step on them..
